§ 1 Scope of application

The following terms and conditions apply to all the orders placed on our online shop.

§ 2 Contracting parties and conclusion of contract

The contract of purchase is concluded with UNIQUE Fragrance GmbH.

By placing products in our online shop we submit a binding offer upon the conclusion of an agreement on these articles. This agreement is completed when you place a binding order for the products in your shopping basket by clicking the order button. Immediately after submitting your order you will receive another confirmation by e-mail.

A binding contract can also be concluded beforehand as follows:

  • - If you have selected credit card payment, the contract is concluded at the time of credit card debiting.
  • - If you have selected PayPal as the mode of payment, the contract is concluded as soon as your payment instruction is received at PayPal.
  • - If you selected the Instant Transfer payment, the contract is concluded as soon as your payment instruction is received at SOFORT AG.
  • - If you have selected Giropay as the mode of payment, the contract is concluded as soon as your payment instruction is received at Giropay.

§ 3 Code of Conduct

§ 4 Shipping costs

(1) Shipping costs get added to the specified product prices. More information about the shipping costs is provided with the offers.

(2) UNIQUE ships its products in Germany, to Europe and across the globe through DHL. Vouchers are sent via Deutsche Post AG. A return slip for the return shipping within Germany can be found on the DHL return portal. The corresponding link can be found here.

(3) A note on the Regulation on the Avoidance and Recovery of Packaging Waste: As a manufacturer and distributor or trader, UNIQUE must take back the packaging and bring them to an environment just utilization once they have served their purpose. UNIQUE happily informs its customers about the public collection facilities for free disposal of packaging available within a reasonable distance. If there is no such place available to a customer, the packaging can be after prior consultation sent back to UNIQUE for free (or at a cost), so that it can be treated in an environmentally compatible way for re-use.

§ 5 Payment

You have the following payment options available at our online store:

Cash in advance
In the case of advance payment, we send you our bank details along with the order confirmation and deliver the products after payment.

Credit card
Your credit card account will be charged as soon as the ordering process is completed.

You pay the invoice amount online via PayPal. You must in principle be registered or first register with PayPal, legitimize with your login and confirm the payment instruction (except in the case of guest access). Further information is available during the order transaction.

Instant Transfer payment
We obtain the transfer credit immediately. This accelerates the entire ordering process. All you need is the account number, bank code, PIN and TAN. Using the secure Sofort AG payment form, inaccessible to any merchant or third part, automatically triggers a credit transfer in real time to your online bank account. The purchase amount is instantly and directly transferred to the bank account of the merchant. If you choose the Instant Transfer payment option, a pre-filled form appears at the end of the ordering process. This already contains our bank account details. In addition, the transfer amount and the reason for payment are already displayed in the form. You must now select the country where you have your online banking account and enter the bank code. Then enter the same data that you enter while performing online banking (account number and PIN). Confirm your order by entering the TAN. Immediately afterwards, you will receive a transaction confirmation receipt. Basically, every internet user can use the Instant Transfer payment option, if he has an activated online banking account with PIN/TAN procedure. Please note that some banks do not yet offer the Instant Transfer payment option. To know whether your bank provides this service or not, please check under:

You pay the invoice amount using your online banking account, to which you are forwarded to during the ordering process. Sign In as usual, using your account number and PIN, and authorize your payment e.g. with a TAN. Your bank must be a participant in the Giropay process.


§ 6 Self supply reservations

UNIQUE is entitled to withdraw from the contract insofar as it does not receive the delivery or receives incorrect delivery of products in turn in spite of previous conclusion of a corresponding procurement agreement (concrete hedging transaction). UNIQUE is obliged to inform the customer about the unavailability of the service immediately. Services already paid by the customer, the total price, will be refunded immediately upon exercise of the right of rescission.

§ 7 Copyrights

UNIQUE allows the customer to use the images or motifs that are used in the fabrication of the product only for the purpose for which the product is meant.

§ 8 Obligations of the buyer

(1) Insofar as the customer imparts content for the fabrication of a product, he assures UNIQUE that he is authorized to distribute and reproduce the submitted content.
(2) The customer warrants that the submitted content does not violate applicable law.
(3) The customer warrants in particular,
a) that no illegal, violence glorifying or racist patterns, materials and contents are submitted;
b) that no laws protecting young people or criminal laws are violated by the contents. This applies in particular to the legal provisions of §184 ff StGB (Dissemination of pornography), §185 ff StGB (Insult, Slander, Defamation) as well as the provisions of the Interstate Treaty on the Protection of Minors;
c) that the submitted contents do not violate any copyright, trademark or other third party property rights, the general right of personality or other third party rights.

§ 9 Collection by the customer

We only deliver through dispatch. A collection of the goods by the customer is not possible.


§ 10 Coupons / Gift Cards

(1) UNIQUE offers vouchers that can be used by the customer or passed on as a gift to third parties. 
(2) The voucher can be used for redemption of the par value stated on the coupon to purchase the services offered by UNIQUE on its website.
(3) The voucher can be redeemed within the statutory limitation period of 3 years. The period begins on the last day of the year in which the voucher is purchased.
(4) The voucher can be redeemed fully or partially. In case of a partial redemption, the residual value is retained and can be redeemed at a later date.

§ 11 Liability

(1) UNIQUE shall be liable for damage arising from causes other than the detriment to life, body and health only to the extent that such damage arises from wilful misconduct, gross negligence or the culpable violation of a fundamental contractual obligation on the part of MyParfum, its employees or a vicarious agent. This also applies to damages resulting from the breach of obligations in contract negotiations and in the event of impermissible actions. Any further liability for damages shall be excluded.
(2) Apart from deliberate or grossly negligent actions, the breach of a material obligation and the detriment to life, body and health on the part of MyParfum, its employees or a vicarious agent, liability is limited to the typically foreseeable damages at conclusion of the contract and, moreover, to the amount limited to the typical average contract damage. This applies also to the indirect damages, including lost profits.

§ 12 Retention of Title

The products remain our property until full payment.


§ 13 Transport damage

If goods should be delivered with obvious transport damage, please inform the delivery company about this without delay and please also get in touch with us immediately. Failure to timely complaint or notifying us will not infringe on your statutory warranty rights but will help to validate our own claims toward the carrier and/or transport insurance.

§ 16 Return & refund regulations for perfume line orders with +10 flacons

All above stated terms and conditions are not valid for orders of perfume lines with a total quantity of more than 10 flacons. By paying his order the customer confirms and accepts to have no right trevocation and return.
